Title and Job responsibilities dont matter as long as they are same or similar. Your GC Labor has been approved for the title 'Analyst Programmer', so its well worth an effort for you to carry that forward (in same or similar lines).

Hello,
You can not (lawfully) re-enter on an H1B, as you're out of status. If you get caught lying at the border, you will be turned back and will likely be permanently barred from entering the U.S. You'll want to re-enter on an H4 visa - you dont need an H4 petition, although obviously you'll need to qualify for the H4, so be prepared to document your spouse's H1 approval and valid status.
Are you stating that you were laid off (thus overstaying), or that you were benched without pay (meaning your employer should have been paying you)? With more than 90 days out-of-status, you may have triggered a period of ineligibility to re-enter the U.S.
Given the apparent overstay issue, I suggest consulting an immigration lawyer.

As per the new regulation, you can apply for VISA in any consulate in INDIA. This removes the ambiguity of choosing/justify the choice of a different consulate other than the one in your consular district. Refer to the link below. Hope this helps!!!

I don't think anybody ask for an EVL at POE! And even if they ask, there are no 'format' requirements. If you want, you can just take a standard EVL mentioning your salary, duration of work and title - that should be it.

Is my perm valid if I am out the US without H1 B status? OR
Can I get H1B extension if my perm & I 140 get approved when I am out of the US without H1B status?
Here is my situation:
-My I140/I485 got denied -- in Aug 2009
-I got 9th H1B extension which is valid till Apr 2010
(As I know after Apr 2010 that I am not eligible to get extensions)
-My present company started filing PERM in Dec 2009 (No chances of getting PERM & I 140 approvals before Apr 2010)
-My company planning to send me out of the US (probably India/Japan) in Apr 2010 to work from there because of my H1B expiration. They want to continue my PERM and I 140 process.
My question to the attorneys:
If my PERM get approved after 6 or 8 months I am eligible for H1B extension even though I am out of the country without H1 B status?
Or
Do I need to wait 1 year to get the new H1B for 3+3 years?
I really appreciate your suggestions.

Recently my company got acquired by another company. Co A had filed for my LC, and was approved in Feb 09, and my i140 was filed in EB3 in Sept 09. Co B wants to keep me, and I will continue the same job. My H1 has also been transferred to Co B. My question is:
will there be any effect on my LC and I140? If so, what happens to my PD (Nov 08)
If company A got fully merged into company B and it no longer exists as a entity, then company B will have to file a successor in interest petition (I-140).

Can someone work in US on H1B and in India for an Inidan company and get paid in Inidan currency? If H1B restricts you from doing so I am willing to switch to EAD if that permits me from working remotely for indian company.
that's how infy, wipro, tcs work...they get ppl here on H1 and get paid in dollars....once they go back to india, they get paid in rupees....u need h1 if ur in the US.

If the new PWD guidelines were effective 01/01/10, then it shouldn't effect your PWD since it was filed on 12/30/09. You should try and find some document or FAQs to prove the same and send them to your lawyer. My guess is he might have messed up something in your process and is trying to cover it up with this story. Its better to have him re-start the process in that case because if he infact messed up something and he files your PERM, it could be potentially denied which will directly impact you...Try to find out if what he is saying is infact true (which I doubt), or if he is just mistaken..

A background on my case. I have a valid H-1, stamped on my passport. Also, I have my GC in process for 4.5 yrs. My husband was on pending I-485 & working on EAD. In may 2010, my pending I-140 was denied and then appealed. And following that, both mine & my husband's I-485 was denied after 2 months. Our lawyer did file MTR within 30 days of I-485 denial and its still pending:
Questions:
1) Can my husband apply for H-4 by being within USA or he has to leave the country?
2) Also, since he is not on any non-immigrant status, does the accrual of 180 days of illegal stay apply to him?
3) If it does apply, what are the chances of him getting the H-4 approved if he applies from Canada or home country?
4) & If he leaves the country, is he abondoning the pending MTR of I-485 which would lead him be out of the GC process completely?
Any expert input & feedback on my queries will help me to figure out my scenario. I have consulted couple of lawyers on my case, but all of us has mixed feedback which is making it very tough to get the right answer & make the right decision. I am in complete messy situation right now.
Also, if somebody gone thru or going through the similar situation pls. let me know what was the result on your case. Ur help is highly appreciated

Dear All,
I am filing AOS for my wife. I noticed G-325A is only single page now, I remember when I submitted mine it was 5 pages. Is it changed to 1 page only or I need to make 5 copies of that single page.
I am submitting AOS and EAD, according to my understanding only 2 photo for AOS and 2 photo for EAD, total 4 photos are required. I saw in some forum they are saying about 6 photos. Am I missing anything...

I didnt mean to burst your bubble...but may be its just that you are getting another finger printing notice. Its expires in 15 months. If you read the other forums July 07 filers have started getting their next set of FP notices. I wouldnt get too carried away.

My sister is planning to visit us here this summer. she is scheduled for visa interview next month. (me & my sister who is citizen ... are sponsoring her)
little caveat, my sister has filed immigration file for her (about 2 years back...it usually takes 10-15 yrs for sibling family visa). just want to know anyone has seen or encountered such case. (in her visitor visa forms we have disclosed all this, meaning immigration file number n all)
is there any specific question that they may ask....or does it make her in-eligible for visitors visa ?
